1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of TravelMedID (the "Service"), operated by TravelMedID ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Please also review our Privacy Policy, which explains how information is handled and is incorporated into these Terms by reference.
2. Description of the service
TravelMedID provides a digital travel medical card, including features such as: a passport-style card with medical and contact information, exportable PDF and printable formats, emergency QR codes, an optional traveler's insurance activation link, a phrasebook translation tool, trip advisory and embassy lookup links, and optional medical record storage.
The Service stores most of your information locally on your own device rather than on a central server, as described in our Privacy Policy.
3. Not medical advice or emergency services
In a medical emergency, contact local emergency services directly. Do not rely on TravelMedID as your sole means of obtaining emergency care or as a guarantee that the information displayed will be accurate, current, or sufficient for treatment decisions. You are responsible for verifying the accuracy of any information you enter and for keeping it up to date.
4. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service on your own behalf. The Service is not directed to children under 13, consistent with our Privacy Policy.
5. Accounts and data storage
TravelMedID does not require you to create an account. Your card data, contacts, insurance details, and any uploaded files are stored locally on your device. You are responsible for the security of your own device and for backing up or exporting your information, since we do not maintain a central copy that can be recovered if you lose access to your device or clear your browser/app data.
6. Your content and uploads
"Your Content" means any information, files, photos, or documents you enter into or upload through the Service, including passport details, medical information, insurance information, and any uploaded medical records or insurance cards.
You retain all ownership rights in Your Content. Because Your Content is stored on your device and not transmitted to our servers in the ordinary course of using the Service, we do not claim any license to use, reproduce, or distribute it. You are solely responsible for the accuracy, legality, and appropriateness of Your Content, and for ensuring you have the right to upload any document you provide (for example, that a medical record belongs to you or a person for whom you are authorized to act).
7. Medical records feature
The medical records upload feature is entirely optional. If you choose to use it:
- Files are stored only on your device and are not transmitted to or viewable by us, as described in our Privacy Policy.
- You are responsible for the content of anything you upload and for removing it from your device if you no longer wish to retain it.
- We make no representation that uploaded files will be readable by, or acceptable to, any third party (such as a clinician, border official, or insurer) you choose to show them to.
8. Insurance activation and third-party services
TravelMedID provides a link to activate a traveler's insurance policy through TW Global Protection (twglobalprotection.com), and reference links to U.S. government travel advisory and embassy lookup resources (travel.state.gov, usembassy.gov, step.state.gov). These are independent third parties.
We do not sell insurance, are not an insurance agent or broker, and are not a party to any policy you activate or purchase through a third-party link. Your relationship with that policy, including coverage terms, claims, and disputes, is solely between you and the third-party provider, governed by their own terms and policies. We are not responsible for the accuracy, availability, or content of any third-party site we link to.
9. Acceptable use
You agree not to:
- Use the Service to store or present false identity, passport, or medical information with intent to deceive a third party (such as border officials, medical personnel, or insurers).
- Upload content that infringes another person's rights or that you do not have authorization to use.
- Attempt to reverse engineer, disrupt, or interfere with the proper functioning of the Service.
- Use the Service for any unlawful purpose.
10. Intellectual property
The Service, including its design, text, graphics, and underlying code (excluding Your Content), is owned by TravelMedID or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written permission.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION DISPLAYED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY QR CODE, EXPORTED DOCUMENT, OR DISPLAYED INFORMATION WILL BE ACCEPTED BY ANY THIRD PARTY.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVELMEDID AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOSS OF DATA STORED ON YOUR DEVICE THAT WE DO NOT MAINTAIN A COPY OF. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless TravelMedID from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.
14. Termination
You may stop using the Service at any time and delete your locally stored data through the in-app options. We may suspend or terminate access to the Service, in whole or in part, at our discretion, including for violation of these Terms.
15. Governing law
(If you'd like to lock venue to a specific county — e.g., wherever your registered office is — let us know and we'll add it.)
16. Dispute resolution and arbitration
Agreement to arbitrate
You and TravelMedID agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (a "Dispute") will be resolved by binding arbitration on an individual basis, rather than in court, except that either party may bring an individual action in small claims court if it qualifies, or seek injunctive relief in court for misuse of intellectual property or unauthorized access to the Service.
Class action waiver
YOU AND TRAVELMEDID AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.
Arbitration procedure
Arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable consumer arbitration rules, and will take place in, or be conducted by remote means consistent with, Michigan. The arbitrator's decision will be final and binding, subject to limited judicial review.
Opt-out right
You may opt out of this arbitration agreement by sending written notice to the email address in Section 18 within 30 days of first accepting these Terms, clearly stating that you decline to be bound by this arbitration provision. If you opt out, this arbitration section will not apply to you, but the rest of these Terms will remain in effect.
Severability of this section
If the class action waiver above is found unenforceable as to a particular Dispute or remedy, that Dispute or remedy will proceed in court, but the remainder of this arbitration agreement will still apply to all other Disputes.
17. Changes to these terms
We may update these Terms from time to time. We will update the "Last updated" date above when we do. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
